PAIA Manual

This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), as amended. It explains what records TruNrth Intelligence holds and how to request access to them.

Since 1 January 2022 every private body in South Africa must have a PAIA manual, regardless of size or turnover. This manual is available on this website and at our premises during business hours, and will be provided on request.

2. The PAIA Guide

The Information Regulator has published a guide, in terms of section 10 of PAIA, on how to use the Act. It is available in all official languages from the Regulator:

3. Records held

The following categories of records are held by TruNrth Intelligence. Listing a category does not mean the records will automatically be released — requests are assessed against the grounds for refusal in Chapter 4 of PAIA.

4. Records available without a formal request

The following are freely available on our website without a PAIA request: our services and company information, this manual, our Privacy Policy, our Legal & Terms page, and published articles. No notice has been published under section 52(2) of PAIA.

5. Records kept in terms of other legislation

Records are kept in accordance with, among others, the following legislation. Listing an Act does not mean those records are available on request — they remain subject to the grounds for refusal in Chapter 4 of PAIA.

6. How to request a record

  1. Complete the prescribed Form 2 (Request for Access to Record of Private Body), available from the Information Regulator's website.
  2. Send it to the Information Officer at admin@trunrth.co.za or the address above.
  3. Provide enough detail to identify the record and yourself, state the form of access required, and state which right you are seeking to exercise or protect and why the record is required for that purpose.
  4. Pay the prescribed request fee where applicable (personal requesters seeking their own information are exempt from the request fee).
  5. We will respond within 30 days. This may be extended by a further 30 days in the circumstances allowed by PAIA, and we will notify you if that happens.

7. Fees

Fees are those prescribed under PAIA and published by the Information Regulator, and are payable in the prescribed circumstances (a request fee, and where access is granted, an access fee for reproduction, search and preparation time). The current fee structure is published at the Regulator's PAIA fees page.

8. Grounds for refusal

Access may be refused on the grounds set out in Chapter 4 of PAIA, including protection of a third party's privacy, commercial information of a third party or of TruNrth Intelligence, confidential information, legally privileged records, and research information. Where the public interest override in section 70 applies, access will be granted despite these grounds.

9. If your request is refused

There is no internal appeal against a decision of a private body. You may apply to a court as contemplated in section 78 of PAIA, or lodge a complaint with the Information Regulator, within 180 days of the decision.

10. Processing of personal information (POPIA)

As required by section 51(1)(c) of PAIA, read with POPIA, the following describes the personal information we process. Full detail is set out in our Privacy Policy, which forms part of this manual.

Planned transborder flows of personal information

Certain service providers we use (including our website host and email provider) store data on servers outside South Africa. Such transfers are made in accordance with section 72 of POPIA.

Security measures

We apply reasonable technical and organisational measures as contemplated in section 19 of POPIA, including access control, encryption in transit, restricted access on a need-to-know basis, and maintained software.

11. Availability and updates

This manual is available free of charge on this website, and at our premises for inspection during normal business hours. It is reviewed and updated as necessary.
